Terms of Service

1. The service

GoodApples helps professionals and schools stay in touch with their clients. It keeps client records, suggests who to call and what to say, files notes you give it, and sends you reminders. GoodApples is currently invite-only. We may add, change, or remove features over time.

2. Your account

You must be at least 18 and able to enter a contract to use GoodApples. You sign in with one-time codes sent to your email, so keep your email account secure. You are responsible for activity on your account. Tell us right away through our contact form

3. Subscriptions and billing

• GoodApples is offered on a monthly subscription. Current prices are shown on our website and at checkout.
• Subscriptions renew automatically each month until canceled. You can cancel at any time in your account; cancellation takes effect at the end of the current billing period.
• Payments are processed by Stripe. Except where required by law, fees are non-refundable, including for partial months.
• We may change prices with at least 30 days' notice. The new price applies at your next renewal after the notice period.

4. Your content and your clients' information

• You own the information you put into GoodApples, including your client records and notes (“Your Content”).
• You give us permission to store, process, and display Your Content only as needed to provide and improve the service for you, including processing by the service providers listed in our Privacy Policy.
• You are responsible for Your Content. You confirm you have the right to store and use your clients' information in GoodApples and that you will use it lawfully.
• Testimonials: you may share a client's testimonial publicly only if the client gave permission in the update form or otherwise, and only with the name format they chose.

5. Following the law in your profession

You are responsible for complying with all laws and professional rules that apply to you, including:

• Rules on referral fees and gifts, such as the Real Estate Settlement Procedures Act (RESPA), state real estate and insurance regulations, and rules governing attorneys and accountants. GoodApples does not support paying anyone for referrals, and our coaching never recommends it.
• Laws on calls, texts, and emails, such as the Telephone Consumer Protection Act (TCPA) and CAN-SPAM. Messages to your clients are sent by you, from your own phone or email.
• Privacy laws that apply to your clients' information, including laws about children's information if you are a school.

6. AI suggestions

GoodApples uses artificial intelligence to suggest what to say and to organize your notes. Suggestions may sometimes be inaccurate, incomplete, or not right for a situation. They are drafts for your judgment, not professional, legal, or financial advice. Review every suggestion before you use it. You are responsible for what you say and send.

7. Acceptable use

You agree not to:

• Use GoodApples to send spam, harass anyone, or contact people who have asked not to be contacted.
• Upload information you don't have the right to use, or sensitive information such as Social Security numbers, financial account numbers, or health records.
• Try to access other users' data, break or overload the service, or copy, resell, or reverse engineer it.
• Use GoodApples for anything illegal.

8. Our content

GoodApples, including its software, design, coaching content, and the GoodApples Code, belongs to us and is protected by law. You may use them only as part of your subscription. The GoodApples Code and other member materials are for your own use and may not be republished.

9. Suspension and termination

You can close your account at any time. We may suspend or close accounts that violate these Terms or put the service or others at risk. After your account closes, we will delete Your Content as described in our Privacy Policy. You may request an export of your client records before closing your account.

10. Disclaimers

GoodApples is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that GoodApples will be uninterrupted or error-free, or that using it will result in any number of referrals or any amount of business.

11. Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim relating to GoodApples is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You agree to defend and hold us harmless from claims arising from Your Content, your messages to your clients, or your violation of these Terms or any law.

13. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Clark County, Nevada, and you and we consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms. If we make material changes, we will let users know by email or in the app at least 14 days before they take effect. Continuing to use GoodApples after that means you accept the updated Terms.

15. Contact us
